May kakayahan si dating Pangulong Rodrigo “Digong” Duterte na lumahok sa mga pre-trial proceeding ng International Criminal Court (ICC), ayon sa independent panel ng mga medical expert.
Sa dokumento mula sa panel na may petsang Dis¬yembre 18, inirekomenda ni ICC deputy prosecutor Mame Mandiaye Niang sa ICC Pre-Trial Chamber I na ipagpatuloy ang paglilitis.
Ito ay dahil si Duterte ay “capable of meaningfully exercising his procedural and fair trial rights, and that he is fit to participate in the pre-trial proceedings, including the confirmation hearing.”
“Upon completion of their assessments, Panel members individually reached the same overall conclusion that, while frail and elderly, Mr. Duterte nevertheless possesses the necessary capacities to meaningfully exercise his procedural and fair trial rights,” dagdag pa ni Niang.
Ipinaliwanag din nito na naiintindihan umano ni Duterte ang kinakaharap nitong kaso, kabilang ang mga ebidensiya, layunin at posibleng epekto ng mga pagdinig, gayundin ang kakayahan nitong gabayan ang kanyang abogado sa paghahanda ng depensa.
Ngunit hinamon naman ng abogado ni Duterte na si Nicholas Kaufman ang report ng panel, na sinasabing may internal inconsistencies at humiling ng evidentiary hearing upang linawin ang mga konklusyon ng eksperto.
“The Defence submits that although the Panel considers Mr. Duterte competent for the purpose of the pre-trial proceedings, the means by which each member of the Panel reached his conclusions stridently conflict with those of the others,” giit ni Kaufman. “Such internal inconsistencies undermine the overall weight of the general joint conclusion on fitness.”
Samantala, sa ngayon ay wala pang pinal na desisyon ang ICC Pre-Trial Chamber I tungkol sa kahilingan ni Duterte na ipagpaliban ang proceedings dahil sa umano’y “cognitive decline”.
Nahaharap si Duterte sa kasong crimes against humanity kaugnay ng kampan¬yang war on drugs sa ilalim ng kanyang administrasyon.
Wish naman ni House Deputy Minority Leader at Mamamayang Liberal party-list Rep. Leila De Lima na manatili ang maayos na kalusugan ni dating Pangulong Duterte upang maharap umano nito ang parusa sa kanyang mga kasalanan.
“Ang wish natin ngayong Pasko: Magtuloy-tuloy na ang kaso and for him to stay healthy to face his punishment,” sabi ni De Lima sa isang social media post.
“Panagutin din sa ICC ‘yung iba pang mga sangkot—‘yung chief enforcer at iba pang enablers ni Duterte sa kanyang huwad na war on drugs!” dagdag pa ng lady solon.
